A Golden man is facing five felonies after allegedly shooting a person at a home in rural Stone County on Sept. 29.
Angelo Lumetta, 20, of Golden, is charged with first-degree assault (attempted murder), two counts of armed criminal action, first-degree burglary and tampering with a witness.
According to a probable cause statement filed by Sgt. Paul Algya, with the Stone County Sheriff’s Office, at about 11 p.m. on Sept. 29, dispatch advised deputies a victim had been shot in the chest and the suspect, whom the victim identified as Lumetta, had fled the scene.
Algya said another deputy on the scene informed him the victim was set to testify against Lumetta in an upcoming case. The victim was transported to a hospital with life-threatening physical injuries.
Security footage from the home shows a male walking up to the front door and knocking. He then allegedly pointed a handgun at the door and waited for someone to answer. When the victim answered the door, a struggle ensued, with the victim trying to close the door and the suspect trying to push it open.
The suspect then allegedly stuck the handgun inside the door and residence and shot the victim in the upper left chest area with a .22-caliber firearm.
A search of the Flock camera system allegedly showed two images of a truck Lumetta tim earlier in the day. The first image was captured at 10:23 a.m. on Sept. 29, and the second at 9:58 p.m. the same day. The camera is located about 3.6 miles from the victim’s house.
The vehicle was later located at Lumetta’s residence in Golden, where Stone and Barry County deputies arrested Lumetta in the early morning hours of Sept. 30.
In an interview with a Stone County detective, Lumetta allegedly stated he went to the victim’s house to talk, and when the victim opened the door, he stuck the gun inside and fired one round. Lumetta said he then left and ran to his truck parked at a nearby location and drove home, allegedly disposing of the firearm, which he said was a Sig Sauer .22-caliber handgun, by throwing it out the window while driving.
Lumetta is being held in Stone County on no bond. He has been arraigned, and a hearing was held on Tuesday, with a preliminary hearing set for Oct. 29 at 1:30 p.m. in the courtroom of Judge Eric Chavez.
Lumetta faces felony charges in two other cases this year, one on Feb. 11, and another on Feb. 18. The first case carries charges of first-degree burglary, stealing $25,000 or more, first-degree property damage and first-degree trespassing. The second case has a first-degree burglary charge. Both cases have hearing set in October.
