Assault charge added in car theft case

A Fulton man charged with allegedly stealing a vehicle in Barry County is now facing an additional charge relating to the incident.

Richard Burwell, 31, of Fulton, was charged on Jan. 13 with first-degree tampering with a motor vehicle. On Jan. 27, after further investigation according to Barry County Sheriff Danny Boyd, another charge of second-degree assault was filed.

According to a probable cause statement filed by Deputy Mike McGuire, with the Barry County Sheriff’s Office, the alleged vehicle theft was committed on Jan. 9 at about 10:30 p.m. at a location in Barry County.

McGuire said Burwell allegedly took a motor vehicle from the victim without permission, and he allegedly showed McGuire the location of the stolen vehicle and admitted bringing it to the location where it was found.

According to a second probable cause statement filed by McGuire, in the course of stealing the vehicle, Burwell allegedly willfully hit the victim with the vehicle, causing the victim to land on the hood of the car, hit the windshield and land on the roadway unconscious.

The victim sustained a cut to the forehead, a concussion, bruising on both legs and road rash on all arms and legs.

Burwell has a criminal history in Barry County, pleading guilty to two counts of tampering with a motor vehicle and forgery in April 2022, and he is currently on probation for pleading guilty in October 2022 to two counts of stealing a motor vehicle, two counts of stealing – $750 or more, and first-degree property damage. Those incidents spread four separate cases for charges originating in 2021 and 2022.

For each current case, Burwell is being held on a cash-only bond of $15,000 — $30,000 total. Preliminary hearings in the cases are scheduled for Feb. 20 at 1 p.m. in the courtroom of Judge Robert Foulke.
